Introduction

An indefinite quantity supply contract has been developed to help meet the ever increasing demands for toilet and utility buildings.These contracts are for single and double unit precast concrete vault comfort stations, single and multiple unit flush toilet buildings, and general utility buildings.The contract was solicited on a basis that will permit flexibility of allowing Forest Service regions and other USDA and US Department of the Interior Agencies throughout the United States to place delivery orders for precast concrete buildings.

GLOSSARY

Wherever referred to in this document, the following terms have specific meaning.  They are listed here for clarification and for those persons unfamiliar with the terminology.

Contracting Officer (CO) - The Forest Service administrator of this contract and sole authority with regard to changes and mediation. This person is David H. Johnson, Rocky Mountain Region AQM Cody WY. (Note: phone numbers, email addresses for CO, COR are listed at the end of this document.)

Contracting Officer's Representative (COR) - The Forest Service technical administrator of the contract, authorized by the Contracting Officer to monitor daily progress of the contract, serve as liason in routine matters with the Contractor, and provide technical assistance to the Ordering Units. This person is Gerardo Chavarria, Rocky Mountain Regional Office.

Contractors - The parties awarded the contract to supply precast concrete buildings by the provisions of this contract. In this case, the Contractor is CXT, Inc. (see above for information).

Contract Information Booklet - The Contractor's information regarding the building styles and options available on this contract including photos, specifications, installation prerequisites, etc. The Contract Information Booklet is posted on the Forest Service Contract Page of the Contractor's website.

Designated Inspector - The on site contact employed by the Ordering Unit. The responsibilities and duties of the Designated Inspector are discussed in detail in this document. This person is delegated by the COR through an informal process.

Order Form - The only form by which each individual building is placed on order. Separate forms exist for each building style. The forms contains choices for all available building options and summarize total cost for each building. The form is made available by contact with the Contractor.

Order Package - The total of all information submitted to the Contractor by the Ordering Unit when an order for a concrete building is placed. The Order Package includes Order Forms, a Purchase Order, maps and other information as necessary. The Order Package is detailed in this document.

Ordering Unit - The agency subunit that places the order, such as Forest or District.

Purchasing Agent - The agency authorized procurement officer of the Ordering Unit.

Purchase Order - The actual procurement document that authorizes transfer of funds to the Contractor. For the Forest Service, this is a Type 43 Purchase Order.

Requisitioner - The staff person or group of the Ordering Unit that initializes the order and selects the building style and various options.

Sweet Smelling Technology eliminates odors from comfort stations by tight control of ventilation.

The precast comfort stations being offered under this contract are available in the following building styles:

All buildings meet requirements for ADA and U.F.A.S. All buildings feature Sweet Smelling Technology.

The buildings are shipped as two major separate components; 1) the concrete vault with integral ABS plastic liner, and 2) the joined floor slab and building. Upon arrival, the Contractor sets the vault into the prepared excavation and then sets the floor slab and building upon the vault with a mastic seal between the vault and slab. The Contractor then assembles miscellaneous components including the vent stack and toilet riser. Site preparation and installation may be completed by the Contractor for an additional cost if included with the initial task order.

CONTRACT INFORMATION BOOKLET

Information regarding these building styles, the options available, wall patterns, colors, roof styles, and right or left entry, etc., are detailed in the Contract Information Booklet which can be found on the Forest Service Contract Page on the CXT website (www.cxtinc.com). Note that prices are not listed in the Contract Information Booklet. Prices will be provided to the Ordering Unit upon request for the actual Order Form, obtained either by clicking on building choice in following section, through email or by phone contact with CXT.

These contracts are only for the specific building styles and options included in the Contract Information Booklet. If the ordering unit desires additional features, which are not offered within the scope of this contract, it will be necessary for that agency to conduct a separate procurement. The Forest Service and its administrators of this contract, the Contracting Officer and Contracting Officer's Representative, cannot provide any assistance to procurement of building styles and options which are not specifically listed in the Contract Information Booklet.

ORDER FORMS

The Order Form is obtained from CXT by clicking on the building choice below or by e-mail or phone request. There are separate Order Forms for each style of building. The Order Form provides options for color, floor plan, signage, vent location and various amenities which are available for each unit. The Ordering Unit must specify their choices for these options and total the cost for each building ordered. The cost will also include a calculated mileage charge entered onto the Order Form. The mileage is calculated from the precasting plant in Spokane, WA.,or Hillsboro TX to the point of installation and is figured as one-way mileage. An example Order Form, without prices, is included in the Contract Information Booklet for each building style.

PLACING ORDERS

The Contract Information Booklet contains descriptions, photos, floor plans and all other pertinent information necessary to select the various units and options. A description of the ordering procedure is as follows:


1) The Requisitioner should first verify their ability to order off of this contract through their Purchasing Agent.

2) For vault toilet buildings, the Requisitioner and their relevant staff should complete a site investigation to determine proper building placement with consideration given to the various aspects of Sweet Smelling Technology. Use available engineering and recreation expertise to pick the best site. This is important because location of vent stack (ideally south, with sun exposure), room vent (toward prevailing wind) and floor plan are site specific and contribute significantly to the success of Sweet Smelling Technology. These aspects of design must be specified on the Order Form. (Note: additional site and access considerations are discussed later in this document and in the Contract Information Booklet.)

3) The Requisitioner should thoroughly review the Contract Information Booklet on the CXT website and determine which models, floor plans and options meet their needs.

4) Contact CXT either through email or phone to request the Order Form with included pricing. A link to CXT for obtaining order forms and placing orders is located on the website.

5) Prepare an Order Package and submit it to your Purchasing Agent. The Order Package must include the following information:

- A separate Order Form completed for each building that includes all options and costs. Transportation cost must be included, computed as one-way mileage from Spokane, Washington to the site of installation.

- A Type 43 Purchase Order designation (Forest Service) for delivery orders shall be used. The 281 must be coded as a 22 and a 279 report completed. Consistency in using the type 43 designation will help the contractor maintain a consistent billing procedure. Each delivery order shall have the name of the Designated Inspector with their job title, email address, phone number and fax number. The Designated Inspector information will be written directly on the Purchase Order. The Requisitioner must ensure that the Designated Inspector is provided with all of the installation information, drawings and specifications available on the CXT website.

- A map for each site with clear, written directions from the appropriate major highway junction. This information should include all relevant access roads, mileages and identifiable landmarks as necessary to reach the site. Forest maps are preferred. Please do not provide hand drawn maps unless they supplement a forest map. Maps should be legible when faxed. It is very important that this information is complete and accurate as ordering units may be held liable for delay associated claims due to poor directions.

- Any other pertinent information, including preference for locks and delivery constraints. These items are discussed in detail later in this document. Note: The buildings will not automatically come with the international symbol for accessibility. The appropriate sign should be requested on the order form.

6) Only USDA and USDOI Federal Government Purchasing Agents or Contracting Officers (of the Ordering Unit) are authorized to place delivery orders against this contract. To complete the ordering process, they will send the Order Package including all items listed in (5) to CXT by email, fax or postal mail and request confirmation. Incomplete Order Packages will be returned for completion. CXT will forward copies of completed and accepted Order Packages to the CO.

Only vault toilets are currently available on the CXT contract.

DESIGNATED INSPECTOR

The Designated Inspector should be someone from the ordering unit's engineering department or other employee well experienced in matters of excavation, equipment operation, and truck transport. The Designated Inspector will be the primary link on the Ordering Unit for all communication related to this contract. Formal confirmation by the COR of the Designated Inspector is not necessary, however, the COR reserves the right to review the qualifications of the Designated Inspector and request a more qualified replacement if the COR so chooses.

Designated Inspectors must contact the COR by email, at the time an order is placed, to enable lines of communication. The COR will not track down Designated Inspectors that do not initiate contact. Ordering units will be liable for problems arising from poor communication.

The Designated Inspector is responsible to ensure that the site is accessible for truck transport, the excavation is properly prepared prior to delivery, proper clearance exists for crane operations, and all administrative arrangements are in place as necessary to ensure public awareness and safety during installation. The Designated Inspector must also inform the COR of any highway or bridge restrictions along the route related to weight or weekend transport limitations, etc. Any concerns regarding these operations must be resolved with the COR and Contractor prior to delivery.

The Designated Inspector must be present on site during delivery to direct truck drivers and crane operators to the proper location. They must be able to perform minor site work as necessary (shovelling, base material raking and re-levelling, tree trimming or removal, etc.) at the time of delivery. Backhoe availability is recommended for backfill placement with Tioga models (double unit buildings) at the time of delivery. (The front slab overhangs the vault on Tioga models and proper compaction of fill against the vault may not be possible once the building is set upon the vault.) The ordering unit will be liable for any legitimate claim by the Contractor deemed by the CO to be the result of poor inspection, improper site preparation, or inadequate analysis of transport access.

BUILDING LOCKS

All building styles have two lock mechanisms. The first lock is a privacy lock that is operated by the public during use. This lock is incorporated into the entry door handle and can be engaged only from the building interior. It requires no key for operation.

The second lock is a deadbolt mechanism mounted on the entry door above the handle. This lock is operated from the outside of the building. This lock allows the agency to prevent public access during site closure periods or for other reasons. If the ordering agency desires a lock cylinder with an agency key, or special key (for example all buildings on a site keyed the same), the ordering agency must specify this request in the Order Package and make arrangements to ship the appropriate lock cylinders to CXT prior to manufacture of those buildings. The cylinders must conform to the specifications of a YALE 1152, 1-1/8", 5 Pin cylinder. FOREST SERVICE ORDERS - Region 1 has supplied CXT with Forest Service locks, if a unit is unable to provide the locks when a unit is ordered, locks will be available. However, the unit still needs to supply replacement locks to CXT. Ordering units which specify this option but fail to send the specified lock cylinders in a timely manner will be liable for cylinder installation after delivery of the building(s). If an agency or special cylinder is not specified in the Order Package, the Contractor will install a standard keyed cylinder furnished by the Contractor.

DELIVERY SCHEDULE

The Contract requires delivery within 90 days of order receipt by the Contractor. There may be times when delivery occurs in less than 90 days. The Contractor is required to provide 15 days notice to the Ordering Unit prior to delivery.


The Contractor and Contracting Officer realize that there are circumstances which lend preference or apply constraints to the actual date of delivery and an effort is made to consider these circumstances when scheduling delivery. These circumstances include seasonal weather conditions, concurrent site activities and administrative actions. Any such circumstances affecting delivery dates must be clearly noted in the Order Package. Inclusion of a delivery date, in itself, does not bear any meaning. It must be noted "No delivery before 7/15 due to construction at site" or "delivery requested before 10/30 due to expected snowpack", etc., to clarify the circumstances. The Contracting Officer will authorize delayed delivery requirements. Requests for delivery in less than 90 days will be accommodated to the extent possible.


The Contractor's scheduling process is summarized in the following paragraphs.

When an Order package is received, the Contractor enters those buildings on their manufacturing and tentative delivery schedules. The dates for these items will be sequential or based upon information provided by the Ordering Unit in the Order Package. Tentative delivery schedules are determined with respect to crane mobilization. The Contractor must schedule cranes to travel a circuit within a geographic region in order to maximize their efficiency. Therefore, orders are grouped for consecutive delivery according to geographic proximity.


This also means that multiple building orders will be delivered all at once. In consideration of the large number of orders and wide geographic distribution, it is not possible to accommodate individual preferences for delivery as a matter of convenience (beyond the general constraints noted in the Order Package). The Contractor cannot arrange to deliver Building #1 of your order on Tuesday morning and Building #2 on Friday afternoon and Building #3 next Wednesday after lunch but before the staff meeting, etc. Such complications by any one order throws a wrench in the works for all subsequent customers waiting for their buildings, from the standpoint of both the Contractor and the Government.


The Contractor updates the tentative schedule weekly and sends it to the COR. If the Designated Inspector has contacted the COR when the order was placed, the COR will relay all scheduling information to the Designated Inspector to verify the feasibility of that tentative date. Scheduling problems must be communicated immediately. As the tentative date approaches (approximately 2 or 3 weeks prior), the crane schedule starts to lock in to a determined route. The Contractor will then directly notify the Designated Inspector with a firm date for delivery and make whatever arrangements are necessary.


It is very important for the Designated Inspector to be readily available for contact near and during delivery. Often circumstances arise beyond anyone's control that may delay delivery (weather, highway construction, etc.) or allow delivery slightly ahead of schedule. Contact near delivery is direct between the Contractor and the Designated Inspector, so the Designated Inspector must be reachable by phone.

The Designated Inspector must also be able to flex their time during delivery, especially with multiple building deliveries which may arrive all at once or somewhat staggered over several days. With minor delays and other unavoidable circumstances, the trucks and crane may arrive at any time from dawn to dusk and spill over onto weekends (though this is avoided to whatever extent possible). This may be inconvenient, but please understand that everyone is working hard to deliver these buildings in a timely manner to various customers all over the country. Your patience and flexibility is requested and greatly appreciated.

SITE SELECTION AND PREPARATION

All site work is the requirement of the requesting unit.

This contract includes the option to order site preparation and Installation as described above. This is not a requirement to order this option, but an ordering unit may choose this option.

Designated Inspectors need to coordinate and arrange for the site work independently, and coordinate the timing of the site preparation and building placement. Timely delivery and placement of the ordered units is contingent upon the excavation(s) and base preparations being complete and ready to receive placement of the building(s). Refer to Specification 13129. If the Contractor experiences delays in placement due to Ordering Unit delay in preparing the site, the Ordering Unit may be responsible for compensating the Contractor for the delay. The Designated Inspector needs to be on site when the building(s) are delivered to ensure that questions or concerns can be immediately addressed, and that placement proceeds with a minimum of delay.

These buildings are designed to be as odor free as possible, however, the siting of the building and its maintenance ultimately determines if it will function as intended. Objectionable odors may result if the comfort stations are placed near trees, in shade, or where air flow may be restricted. The most important factor in siting the building is locating it in an open area to take advantage of wind flow. Orienting the building with the back wall facing south may help the convective air movement within the vault and the stack, however, this placement is secondary to siting the building in an open area. Buildings should be located downwind of an occupied recreation area, if possible, so odors don't drift into camping or picnic sites. Another factor to consider is the water table. Vault should not be placed in areas with high water tables. The bottom of the vault needs to be located several feet above the seasonal high water table. Buildings should be located with a minimum separation distance from wells, springs, waterlines, streams, lakes, and ponds as required by state regulations.

Dimensions of the precast vaults are as follows:
Single Vault: Length 14'-7.5", Width 6'-6", Depth* 4'-9"
Double Vault(both with and without chase): Length 14'-4", Width 11'-11", Depth* 4'-9"
* All depth measurements given are from finished floor elevation to exterior base of vault slab (4" vault slab, 4' vault depth, 5" floor slab.
Actual dimensions of excavation should allow a foot of working room around all sides of the building for vault placement. Avoid over-excavation. Actual depth of excavation should place final floor approximately 6" above ground elevation to allow final grading to slope away from building.

Another factor to consider when selecting a site is equipment access. Locations that cannot accommodate large trucks and cranes should not be selected. There may be problems when the site has soft soils, steep hills, sloped area surrounding the site, tight switchbacks, or roads and bridges not rated for highway loads along the access route. Also, keep in mind that the crane needs to have a level area to set it's outriggers for stabilizing the crane.

The buildings are shipped on 18-wheelers (a requirement of highway weight restrictions). These vary from a standard cab with 40 foot trailer to an extended sleeper cab with a 48 foot trailer. If the site cannot accommodate trucks of this size, the Ordering Unit will need to make arrangements to transfer the vault and building to a suitable truck at an off-highway location in proximity to the site. If you have any concerns about road access or site access, contact the COR, Contractor and/or consult your engineering support group

PLEASE REFER TO THE TURNING RADIUS GUIDE FOR ADDITIONAL INFORMATION.

Prepare the site by clearing a 20 foot radius out from the center of the selected location. Trees that might interfere with the swing of the crane arm need to be removed. REMEMBER, these contracts do not cover the site clearing, excavation and backfill, unless included as part of the initial task order. Excavation material should not be placed between the excavated hole and the installers access point. The installer needs a clear path between the crane and the excavated hole. The ordering unit will be liable if the building should settle or tilt following installation, if the excavation and backfilling is done by your own crews or a separate contract.

MAINTENANCE

A maintenance manual will be provided with each delivered unit.

PAYMENT

Payment will be made at the unit prices shown on the order forms for items delivered and accepted.

Payment for units completed but not delivered is appropraite where delivery and placement is not possible due to unfavorable ground conditions or access. Contractor shall furnish satisfactory evidence that the unit has been completed to the ordering office, prior to the request for payment. Contractor shall be responsible for the unit until delivered and accepted by the Government.
